As the subject line states, I sent the certified, itemized, security deposit letter a day late according to WI law. I sent it on January 22 because of the MLK holiday the USPS office was closed on Monday.

I did not return any of the SD because of the neglect, etc, and I went with the prices listed on the Settlement charges guide from the LPA which she initialed when she rented the apt.

My concern is, if she tries to cause problems because th letter was sent on the 22 that could be held against me when she rented the apt.

I know the lease says I have 30 days but WI law says I have 21 days so i always send it before the 21 days is up to cover myself. I got a little behind with the holiday so I wonder if someone knows if that could to be a problem for me? Thanks in advance for comments and/or info.

I do not see how being one day late because of a postal holiday should be of any concern. Did you count the days correctly? You should begin counting the day after the move. Was the day after the move out a saturday afternoon or a sunday? That would factor in your favor.

If the law says you have 21 days, then you have 21 days. It doesn't say 'you have 21 days, but you have 22 days if you're busy and there's a holiday.'

If this goes to court, expect a judge to ask you why you waited until the last minute when you had three full weeks to complete your inspection and get the SDSS in the mail. He will ask why you didn't get it in the mail Saturday instead of waiting until Tuesday.

Next time, you need to get this done early instead of late. The holiday is not an excuse.

One day late, on a holiday weekend, is not an issue. The intent is what the judge will look for. A month late would be too long.

and why exactly did you wait until the very last day (after) to mail?
next time you can be a little bit smarter and post immediately after final inspection

there are many tenants in WI can only be moved out by sheriff's office only. If they moved out on Jan. 22, then you are not late at all................

She is not going to cause problems if she left damages. If she wants to take you to court, just go with the list of damages or pictures. Most tenants don't even know what the state law is....or where to find it. Both judges I have been in front of are more concerned with unpaid rent and the damages.

You could have dropped a first class mail on the 21st and then returned on 22 to sent it certified.
