You are in the hen house here asking the fox for directions to the exit. So, do not expect much constructive help. However, if there is requirement for notice or penalty for breaking the lease you should notify the landlord of your extenuating circumstances and family emergency. It would be cruel of a landlord to deepen your suffering by requiring you to pay rent on an empty unit. Two months is all the landlord would get in a legal action anyway. Now is a good time to test the relationship between you and the landlord. Tell the landlord when you are leaving, repair anything that needs it and leave the place super clean. A death in the family is very disruptive. I hope your landlord understands that your circumstances are not something you chose. And, I hope the landlord does not chose to make it worse for you.

Speaking for the foxes, this IS a landlord site........but you make it sound like we LL's are all unscrupulous dirtbags. Thanks! At least most of us don't hide behind "Anonymous"

      If you type "scum" into the search at the top of the forum page you will see a number of references to residual soap film. A large number also reference landlords but the largest number are landlords calling tenants scum. M-Bone and P-Bone are among the offenders. M-Bone is especially fond of the term
      "section 8 scum." It goes on page after page. The most egregious offender is a landlord who hides behind "Anonymous."

Well, guess I'll have to fight to make it law that landlords cannot charge for not giving a notice ahead of time in cases where the tenant unexpectedly passes. Apparently it doesn't matter if you told a landlord you're going to the hospital for surgery. Next rent was due 5 days after my father's death, and me and my two brothers worked our asses off to move the furniture, etc out of there and cleaned the place before rent for the next month was due. Me and my brother's ages range from 20-25 yrs old, not even out of college yet. Where the hell do we get the money? Tell me that.

Oh, and by the way, his estate it going towards hospital, phone, credit card, and funeral costs.
