LL promised us it was a brand new furnace, we even had to show the prospective upstairs tenants (split-level duplex) the furnace since it was in our apartment (basement/first floor, the top part of the duplex started on "floor 2"). We realized we had no heat back in May, our thermostat wasn't working. LL promised us up and down that it'd be fixed, that he was being screwed by a bunch of people, blahblahblah. Live and learn, I guess. Good thing we don't have kids. Bad environment we were living in, which only happened after new tenants took possession of the second part of the house. Again, I don't think he will willingly pay, but I wouldn't put it past him to move to vacate the judgment to at least buy him some time. BTW Dizzy, I think you were the one telling me I was wrong for moving out and good luck trying to convince a judge I was within my rights to move. Judge asked me 3 questions during the inquest: "Were you current on rent?" "Did you have a lease" and "Do you have a copy of the cancelled security deposit check" -- wasn't that hard to convince him, inquest lasted under 1 minute. ;)
