Of course, when the landlord's lease state's that it is the responsibility of the tenant for pest control, that it implies that the rental was free of pest at that time. Florida law implies good faith in the landlord/tenant relationship with lease terms and conditions. If the landlord cared about the rental property, they should act and prevent any terminite damage from occuring by having a Pest control company come by annually at the least to check for terminites and damage. Why would the landlord depend on the tenant to do so? It also seems that this has been an on going problem that the landlord knows about, or should have been aware of. Your friend has several option, contact the local Health Department, contact Code Enforcement, contact the local Building Department, have an attorney issue a 'seven day notice of repair' to the landlord under Florida law to have the landlord correct the damage and exterminate the terminites.

Thank you MrDan, my friend is actually moving out next weekend, she completed her lease term and wanted to remain in the property, however, the landlord never addressed any of her concerns, including termites, roots growing through the pipes, they also decided to sell the property and have put my friend through a very difficult time having people show up at the property unannounced to view it {including one time of her being in the shower and some strangers just came inside and started looking inside, very scary stuff} and I think what broke the camel's back was when they came in the house when she was away for the weekend and "cleaned" shoving things everywhere and rearranging her belongings without her knowledge. Of course, when she signed the lease last year, she was so excited to get the place that she did not pay attention to what she was signing, and against my advise moved in even after realizing there was a pest problem {cockroach infestation was noticed immediately, termites the first week she was there} so, hopefully she can get her deposit back, but the way the landlords have acted during the tenancy, it's hard to imagine them doing the right thing now. Well, they are also first time landlords, don't think they know much about what to do and how to do things, hopefully some day they find this forum and realize all the things they did wrong and feel lucky nobody ever sued them {I would, knowing all my rights}. Anyway, thank you all!
