Remove name from lease - Landlord Forum thread 266574

We had three people move in a rental. One has moved out and wants her name removed from the lease. How do I do this, is there a form. I do not want to write a new lease as am having the current tenants evicted next time they are late with the payment. They are horrible tenants. The lady who moved was decent and just wants her name off.

She can't be off of it. She signed it and is responsible for everything that happens for the term of it.

It's just a contract.
Get everybody who signed the original lease (including you) to sign an amendment removing the one individual from the lease.

Question is why would you? The more people who are on the lease the more pockets you can reach into if need be. What if she was the one paying more than less. What if after she leaves the rent is not paid.

When you screened these people what was her income compared to the others. Can the others afford to live there without her?

I had tenants ask that one be remove from the lease.
No form on LPA. I found one on EZlandlord.

TENANT VACATING AGREEMENT
(OTHER TENANT(S) REMAINING)


The undersigned Vacating Tenant hereby agrees that he/she has completely vacated the premises known as _____________________________________________ (insert address) or will vacate the premises no later than _______________________. (insert date)

Vacating Tenant and Remaining Tenant understand and agree that Remaining Tenant shall continue to reside on the premises and is subject to all the terms and conditions of the lease agreement and any renewals.

Vacating Tenant agrees to relinquish all rights to any sums which Landlord may be holding on behalf of Vacating Tenant including but not limited to a security deposit, advance rent, any prepaid fees or charges and agrees that nothing is owed to Vacating Tenant by the Landlord or its agent(s).

Vacating Tenant agrees to release, acquit, satisfy and forever discharge the Landlord, owner of the premises, any other owners of the rental premises, any agents of the owners, its owners, agents, employees and assigns, for and from all manner of action and actions, cause and causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, damages, judgments, executions, claims and demands whatsoever, in law or in equity, which Vacating Tenant ever had, now have, or which any personal representative, successor, heir or assign tenant, hereafter can, shall or may have, arising out of the tenancy.

Vacating Tenant agrees to hold the Landlord, property owner and/or its agents employees and assigns harmless for damage or loss to any items of personal property left on or about the premises by Vacating Tenant.
