I have a deadbeat T who has decided to to pay her last months rent before she moves out. I have a waiver of notice in my lease and filed on the 10th. At this point I'm trying to think of ways to cut my loses. Thermostats are in the basement and all units are at 68 deg. I'm not looking to break any laws but not trying to assure their comfort while they squat in my apartment. I was thinking of bumping it down to 60.

Are you trying to say the tenant is "not" going to pay the last month's rent? If so, there were smarter things that you could have done besides monkeying with the thermostat.

This will vary from area to area and those will most likely be different from the state requirements. A quick google gave 68 in Pittsburg and this for Harrisburg:

" The City of Harrisburg has enacted a Housing Code which establishes minimum standards for every building used as a residence. These minimums are used to insure that every residence is safe and sanitary.

Some of the requirements of the Housing Code set out that the owner (landlord) of the property must:

Provide heat between October 1st and May 15th at a minimum of 65° between 6:30 AM and 10:30 PM; 60° during the night and when the temperature is below 0° unless otherwise provided by lease. "

So you will need to read your state and local laws or ask your local housing agency. Upon a quick glance at your state's LL/T, I find no reference to a minimum.

BTW, the PA law info located on this website is outdated. I called the PA landlord tenant office in Harrisburg and the man I spoke to confirmed that the law had been changed since.
