I do not see how being one day late because of a postal holiday should be of any concern. Did you count the days correctly? You should begin counting the day after the move. Was the day after the move out a saturday afternoon or a sunday? That would factor in your favor.

I just can not see a Judge ruling against your good faith effort to comply with the law.

Bill, you would be singing a different tune if this post was about a tenant paying the rent late. Late is late, and is unacceptable.
