Dear Mr. Reno:
My tenant paid first and last months rent plus deposit to move in. After 14 months they gave me 30 day notice and did not pay the rent that last month as I had it up front. Then they did not move out. They have paid me regular timely rent payments from that month on but have not paid back the last months rent. This was 6 months ago. I have ask them to pay the money back even offering to let them pay $100.00 a month until they catch up all to no avail. Technically they are behind in rent as I understand it and I can have them evicted. The woman tenants just had a second child and the male was laid off his job and is now collecting unemployment. I hate to evict them but they are not responding to my request to pay the back rent. What can I do as a final effort to collect the last months back rent prior to filing for possession of my property. I've been letting them slide but cannot continue to do so.

Dear Mr. Reno:
I once had a group of 4 young adults sharing a home I rent out. To avoid any misunderstandings and damages in the future, I had each of them sign the lease and to sign a separate acknowledgement that the rent was not divided by 4 but was due in full, with each of them bearing 100% responsibility for payment: any inability of any one of them to come up with their part of the rent was not MY problem : any shortfalls must be made up by the rest of them with payment due to me in full. Likewise, any damage done by any one of them was the responsibility of all of them..
This way, they policed each other for damage control and money due because they knew they’d each be held personally responsible as well. It left any squabbles about money between the four of them and left me out of it..
It worked well, or else I was just lucky..

When a tenant wants to terminate a tenancy, it is done in one of two ways. Either:
If your tenant wishes to vacate tenancy properly, it usually means giving you, the landlord written Notice to Vacate in a timeframe outlined by your lease agreement. Normally this allows the landlord enough time to prepare and find a new tenant for re-rental.

I was at the Sanitation Commissioners hearing in Town Hall In Babylon.. I received a 816.47 bill from Town Of Babylon Solid Waste Management.. For Lot Clean-Up. No one could tell me what this bill was for..... After MANY phone calls they said they think it was for an eviction I had on 11/29/07... There was just a few items left in the Apt. The sheriff let us carry down the tenants belongings, because it was just a kitchen chair, a vacuum 2 lamps. a pail and the rest of the stuff fit into a garbage bag.. The Sheriff said they would notify Sanitation.. We called Sanitation and they said they would pick it up with regular schedule pick up because it was such a small amount... there is no charge for regular pick up it is included in our taxes...
At the hearing they put up these big pictures of your house and what they picked up...... Well when it came to my house.... They would not look at any of my pictures or paper work... They said I HAD 11/2 TONS OF GARBAGE IT TOOK 3 SANITATION MEN 3/4 OF AN HOUR TO PUT IT IN A REAR LOADER... I SAID THAT IS IMPOSSIBLE. the sheriff would of called the movers if it was that much. MAYBE THEY HAVE THE WRONG HOUSE....

"We have a leak. I want it fixed and then you can come back for your rent."
The leak in question is from the window. When it rains hard, she needs to close the window completely. She was able to show me 1/4 of an inch water she collected in a dixie cup. I enforced the late charge and also used the opportunity in the apartment to make an inspection. I gave her a list of things to correct if she wants her full deposit back. Cathy J., NY
