Move Out Instructions Reminder Letter
This is one of my favorite forms because it saves me time and money when tenants move out according to our instructions. It is one of the LPA Forms that is often overlooked, probably because it is not listed on the LPA Essential Landlord Forms page. It is one of our Free Forms, but I consider it an "essential form" just the same. We send this form to the tenants about a week or two before they vacate. It reminds them specifically of certain tasks and cleaning they should perform in order to get a full security refund. This letter instructs the tenants how to lock up and secure the rental until it can be inspected by the landlord/management, and also where and how the tenants should return all keys. We have found this form to be very effective in helping tenants to be more cooperative when they are moving out.
Attorney's Fee Warning Notice The purpose of the Attorney's Fee Warning Notice is to allow the tenant one last opportunity to pay and avoid an attorney's fee that will be added on to the current charges before you send the account to your attorney . Even though the Urgent Late Notice clearly states that the rent is late, late fees are due and the account is in eviction status, the Attorney's Fee Warning Notice is known to get positive results.
The Criminal Background Authorization & Release Form The Criminal Background Authorization & Release Form will remove any doubt of whether the tenant is being up front with you. Not only will you have the tenant's full authorization to do a criminal report with law enforcement agencies, you also have the written authorization required to obtain a credit report. This form can be used in addition to the LPA Rental Application or independently for the purpose of tenant screening authorization.
Tenant's Notice of Intention to Vacate
This form is used by the tenant give proper written notice to the landlord when the tenant is vacating and states that the tenant will cooperate with
showing the property for re-rental or sale. It includes a place for the tenant to give his forwarding address in order to receive any security refund.
It is an excellent way to help reinforce proper move-out procedure. We always staple a copy of this notice to the back of the tenant's lease
to be used when the time comes for the tenant to give notice to vacate.
Tenant-Finder™ Prospect Qualifying Chart The Tenant-Finder™ Prospect Qualifying Chart helps you break down the evaluation of a rental prospect into five main categories.
Lease Co-signer Agreement The Lease Co-signer agreement may be required in a case when the prospective tenant's references or credit is not satisfactory for the landlord or agent. If you feel there are no better prospective tenants to select, the Lease Co-signer Agreement will make an additional party responsible for the tenant's performance on the lease. You MUST fully check out and credit-qualify the co-signer with an application (preferably an LPA Rental Application) as you would the tenant.

Dear Mr. Reno:
I was looking at the LPA termination of tenancy document. Is it required that NY landlords have a third party physically serve any termination of tenancy forms? If the rental agreement is silent or states that items must be mailed, does that constitute proper service in NY? Phillip in WNT (NY)
A: I've heard both versions, so I can't give you a good answer. Some judges want it "served" just like a summons. The only safe way is to use a third party.
Dear Mr. Reno: My name is Carletta and I live in Ohio. I have been renting my house on a month to month basis for 18 months. I just found out that in Oct. of 07 our house went into foreclosure. I just received a 3 day eviction notice 2 weeks ago. My question to you is Can I sue my landlord for the time he collected rent from me while the bank owned the house? I never had a lease agreement with him.
Your advice would be greatly appreciated. Sincerely, Carletta
A: The landlord can collect rent up until the date of the actual foreclosure sale when title passes to the bank or a 3rd party. Do you know that date? It may have not happened yet.
